A convicted child molester faces new charges of possession of child pornography.
On Friday, the Cass County Prosecutor’s Office filed a Level 5 felony charge against Dale Robert Weaver Jr., 35, of 205 W. North St., Logansport. He is being held at the Cass County Jail on a $5,000 cash or $25,000 surety bond.
According to the Cass County Sheriff’s Department, a search warrant of Weaver’s cellular phone was obtained after an investigation into a theft led law enforcement to suspect something other than stealing was at issue.
On Sept. 3, the Cass County Sheriff’s Department received a report of two stolen trailers from a local company. The company informed Sgt. Patrick Zeider that a 2014 gray box trailer with a fold-down rear door and a 2006 black flatbed trailer had been stolen. He also reported that former employee, Weaver, had made a stop at the facility.
This information caused law enforcement to begin an investigation of Weaver. Through a nearly two-week process, the CCSD found stolen boat seats, and located both stolen trailers after questioning Weaver.
While speaking with Weaver at the Royal Center Police Department, Sgt. Joe Nies and Detective Sgt. Dale Campbell also discovered that a coon dog and a dog box were taken from the company. Weaver admitted he took the dog for use during a hunt, according to a CCSD report.
According to the CCSD report, Weaver stated that he “owned the dog before it was sold.”
He further informed officers of the locations of the two stolen trailers. The flatbed trailer was found at a residence in White County. The gray trailer was found behind a white barn at a Cass County residence.
During questioning, law enforcement officers received consent from Weaver to search his cellphone for messages related to the alleged thefts. Weaver advised he did not consent for a photo search.
Therefore, on Sept. 14, a search warrant for Weaver’s cellphone was granted by Cass Circuit Court Judge Stephen Kitts. Detective Nies then found images of naked children, including those of children who have yet to reach puberty, on a camera roll, according to the probable cause affidavit.
Weaver was arrested on a Level 5 felony child pornography charge, a Level 6 felony theft charge, and class A misdemeanor charge of conversion.
Cass Superior Court 2 Judge Lisa Swaim will hold Weaver’s initial hearing at 8 a.m. Monday, Sept. 21.
An investigation is ongoing.
In 2006, Weaver entered a plea agreement on a Class C felony charge of child molestation. He was sentenced to four years of incarceration, all suspended except for 18 months. One year was spent in jail, with six months served on in-home detention. He also had 2½ years of probation terms and was required to pay a $100 child abuse prevention fee.
